NECTAPAY Terms & Conditions

Please read these terms and conditions carefully before using the NECTAPAY platform and services. By accessing or using our platform, you agree to be bound by these terms and conditions.

1. Account Registration: To use our services, you must create an account with NECTAPAY. You must provide accurate and up-to-date information during the registration process and ensure the confidentiality of your account credentials. You shall not engage in any illegal, fraudulent, or unauthorized activities that may harm our platform or other users. 3. Payment Processing: NECTAPAY provides payment processing services for various transactions. By using our payment services, you authorize us to process your transactions, including the collection and transfer of payment funds. We may impose transaction fees or other charges, which will be clearly communicated to you.
4. Intellectual Property: All intellectual property rights, including trademarks, logos, and content, belong to NECTAPAY. You are granted a limited, non-exclusive, non-transferable license to use our platform and services for personal or business purposes. You may not copy, modify, distribute, or exploit our intellectual property without our prior written consent.
5. Privacy and Data Protection: We value your privacy and handle your personal information in accordance with our Privacy Policy. By using our platform, you consent to the collection, use, and disclosure of your information as described in our Privacy Policy.
6. Limitation of Liability: NECTAPAY and its affiliates shall not be liable for any direct, indirect, incidental, consequential, or exemplary damages arising from your use of our platform or services. We make no warranties or representations regarding the accuracy, reliability, or availability of our services.
7. Termination: NECTAPAY reserves the right to suspend or terminate your access to the platform and services at any time and without prior notice if you violate these terms and conditions. In such cases, we will provide notification specifying the reason for the termination. 
8. Governing Law: These terms and conditions shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any disputes arising out of or relating to these terms shall be subject to the exclusive jurisdiction of the courts in the Federal Republic of Nigeria.
9. Modifications: NECTAPAY reserves the right to modify or update these terms and conditions at any time. We will notify you of any material changes by posting the revised terms on our platform. Your continued use of our services after the changes take effect constitutes your acceptance of the modified terms.

Indemnity Clause for NECTAPAY:

By using the NECTAPAY platform and services, you agree to indemnify and hold harmless NECTAPAY, its affiliates, officers, directors, employees, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to your use of the platform, violation of these terms and conditions, infringement of any intellectual property rights, or any other act or omission that causes harm to NECTAPAY or third parties.

You acknowledge that NECTAPAY acts as a facilitator for payment processing and does not assume responsibility for the products, services, or actions of the merchants or customers using the platform. NECTAPAY shall not be held liable for any disputes, losses, or damages resulting from transactions or interactions between users of the platform.

You agree to fully cooperate in the defense of any claim brought against NECTAPAY and promptly notify NECTAPAY of any such claim. NECTAPAY reserves the right to assume exclusive defense and control of any matter subject to indemnification by you, and you agree to assist and cooperate with NECTAPAY in such cases.

This indemnity clause is intended to protect NECTAPAY and its stakeholders from any legal claims or liabilities arising from your use of the platform. It reinforces your responsibility to use the platform in accordance with the terms and conditions and to conduct transactions responsibly.
